1. Important safety notice — please read first
Aion is an assistive aid, not a replacement for your own judgment. It does not replace a white cane, a guide dog, a sighted assistant, or orientation-and-mobility training.
- Aion's descriptions, navigation, and hazard warnings can be wrong, delayed, or unavailable.
- Do not rely on Aion alone for decisions that affect your safety, such as crossing a street or avoiding a hazard.
- Aion is not a medical device and is not an emergency service. It cannot guarantee contacting emergency responders.
By using Aion, you accept these limits. See our AI disclosure and medical disclaimer.
2. About these terms
These Terms of Service (the "Terms") are an agreement between you and Xheight ("Xheight," "we," or "us"). They cover your use of the Aion app, our software, our voice interface, our website at xheight.ai, and any connected assistive devices (together, the "Service"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
3. Who can use Aion
You must be at least 16 years old. If you are under the age of majority where you live but at least 16, you may use Aion only with a parent or guardian who agrees to these Terms for you.
4. Your account
Keep your login details safe and let us know if you suspect unauthorized use. You are responsible for activity in your account. We handle your data as described in our privacy policy.
5. Your license to use Aion
In short: we give you a personal license to use Aion. You may not copy, resell, or reverse-engineer it.
- We grant you a limited, personal, non-transferable, revocable license to use the Service.
- You may not copy, sell, sublicense, or commercially exploit the Service.
- You may not reverse-engineer or attempt to extract our source code or models, except where the law allows.
6. Face and voice recognition
Some features let Aion recognize people to help you. These are optional and require your consent. If you register another person, you confirm you have their permission. Face and voice patterns are encrypted and never sold. Full details are in our biometric data policy.
7. Acceptable use
In short: use Aion to assist yourself, not to harm or surveil others.
- Do not use Aion to stalk, surveil, or secretly identify people without their consent.
- Do not collect anyone's biometric data unlawfully.
- Do not use Aion for unlawful purposes or to harass others.
- Do not rely on Aion outputs for safety-critical decisions.
8. Connected devices and hardware
Aion may connect to third-party assistive devices and hardware. That hardware is made and warranted by its manufacturer, not by Xheight. Please follow the manufacturer's safety and usage instructions.
9. Subscriptions and payment
Some features require a paid plan. Subscriptions renew automatically until you cancel, and are billed through the App Store, Google Play, or our web checkout. Safety features are never placed behind a paywall. See our subscription, billing, and refund policy.
10. Intellectual property
Aion, our software, and our branding belong to Xheight. You keep ownership of the content you provide, such as photos, audio, and saved memories. You grant us a limited license to process that content only to operate the Service and provide the features you use, consistent with our privacy policy.
11. Third-party services
Aion relies on trusted providers for AI processing, hosting, payment, and support. See our subprocessors page. Their services are governed by their own terms.
12. Disclaimers and assumption of risk
The Service is provided "as is" and "as available," without warranties of any kind to the extent permitted by law. Because Aion is an assistive aid whose outputs can be inaccurate or delayed, you use it at your own risk and remain responsible for your own safety decisions. This does not remove rights you have under mandatory consumer law.
13. Limitation of liability
To the maximum extent permitted by law, Xheight is not liable for indirect, incidental, or consequential damages arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence where that limitation is not permitted.
14. Suspension and termination
You may stop using the Service at any time. We may suspend or end access if you break these Terms or misuse the Service. You can delete your account and data at any time.
15. Governing law and disputes
These Terms are governed by the laws of . We will try to resolve any dispute with you directly first. Your mandatory local consumer-protection rights still apply.
16. Changes to these terms
We may update these Terms. If changes are material, we will update the date above and, where required, notify you in the app or by email. Continuing to use the Service means you accept the updated Terms.
